Board of Examiners in Optometry Complaints

Complaint Form

All complaints must be in writing before the Board will take action.

  1. Submit written complaints to the South Dakota Board of Examiners in Optometry Executive Deni Martin, Executive Secretary, 13537 Dark Timber Ct., Piedmont, SD 57769.
  2. After receipt of the written complaint, the Board’s secretary will send the complaint to the Board’s investigator for evaluation. When this investigation is completed, the Board’s investigator will report the matter to the Board’s attorneys for evaluation and any potential legal action. If a formal contested case hearing is required, it will be noticed and conducted in accordance with state statutes including, but not limited to, SDCL 1-26SDCL 36-7, and relevant administrative rules or federal mandates. In addition, an informal disposition may be made of any contested case by stipulation, agreed settlement, consent order, or default, unless precluded by law, pursuant to SDCL 1-26-20.
  3. After a final decision, ruling, or action by the South Dakota Board of Examiners in Optometry, any party involved in the contested case may appeal to the circuit court, pursuant to SDCL 1-26-30.2.
