South Dakota Board of Chiropractic Examiners Meeting
Chamberlain, South Dakota
September 7, 2016         

 

The board meeting was called to order at 2:00 p.m.  The following members were present: Dr. Jeff Kramer, Dr. Jerrid Goebel, Dr. Dean Berg, and Marcia Walter, Executive Director.  Dr. Kathleen Deutsch and Bev McCracken were granted an excused absence.

The agenda for the meeting was distributed and unanimously approved as mailed. 

M/S Goebel/Berg    to approve secretary's report from June 1, 2016
                                                Passed, no opposition

Marcia Walter presented the financial update.  The state account currently has a balance of $271,192.35 as of August 31, 2016. With no additions or corrections, the board received the financial update as presented.

Dr. Goebel informed the board that no complaints were received, therefore, no investigative report to present. No further action taken.

Marcia Walter reported that there haven't been any peer reviews received since last meeting.  Dr. Sarah Strain has agreed to take over as peer review chairman.  No further action taken. 

M/S Goebel/Berg      to conduct 2017 board meetings quarterly on the first Wednesday of the month with the exception of
                                  September with meetings starting at 2:00 pm central time
                                  Passed, no opposition - 2017 meetings are, therefore, scheduled for March 1, June 7, September
                                 13 and December 6

2017 Legislative session preparation memo from Department of Health was reviewed.  The Board of Examiners will not be submitting any legislation for the upcoming session. 

Dr. Kramer recessed the board meeting at 2:30 p.m. for new doctor matriculation.  The board meeting reconvened at 4:00 p.m.

Dr. Doug Sea, Dr. TJ Stotz, Dr. Tom Stotz, Dr. Jerry Fogel and Dr. David Fogel joined the board meeting and shared the SDCA's proposed draft legislation for corporations to enter into employment agreements with chiropractors.  Craig Kennedy, board attorney also joined the meeting for discussion. 

A request for review of a practice members vs. insurance model type of practice was reviewed.

It was opined that this type of practice would be in violation of ARSD 20:41:09.01.

                             91611, 91612, 91613 pending completion of their files 
                            Passed, no opposition
