Statutory Definition
- "Abortion," the intentional termination of the life of a human being in the uterus, provided the term does not include:
- Medical treatment that is provided to a pregnant female and results in the accidental or unintentional death of the unborn child;
- Treatment to resolve a miscarriage;
- The treatment or removal of an ectopic pregnancy;
- The removal from the uterus of a deceased unborn child; or
- Any medical procedure performed for the purpose of saving the life or preserving the health of the unborn child.
Reporting Requirements
Legal Authority
South Dakota Codified Law § 34-23A-19 requires physicians and facilities performing abortions to submit reporting information to the South Dakota Department of Health.
Key Reporting Obligations
- Submit a Report of Induced Abortion Form following each abortion.
- Collect and report aggregate data annually (age, race, marital status, city, county, gestational age, cost, and complications), even though patient identities remain confidential.
- Use prescribed forms such as the Voluntary and Informed Consent Form and Parental Notice Form (if applicable).
