- SDCL Chapter 34-12 – Laws for Health Care Facilities and Related Institutions
- SDCL 34-12-32 defines residential living and the registration requirements and states “Any person engaged in the business of operating a home or facility for the purposes of providing residential services for compensation to two or more elderly or disabled persons not related to owner by blood or marriage shall register annually with the State Department of Health, under otherwise required to be licensed under this chapter. As used in this section, the term, ‘residential services,’ means room, meals, and daily living services, but not habilitative or health care…Failure to register pursuant to this section is a Class 2 misdemeanor.”
