Procedures for Change of Ownership

Listed below are requirements for transfer of ownership of a pharmacy; application for the South Dakota controlled substances registration; and the DEA registration.

Board of Pharmacy Requirements: At least 30 days before the transfer of ownership the “Application for Permit to conduct a Pharmacy” must be sent to: South Dakota Board of Pharmacy, 3701 W. 49th St., Suite 204, Sioux Falls, SD 57106-3115. The application form is located in the Opening a Pharmacy section. 

Within ten days after the transfer of ownership, the previous South Dakota Pharmacy Permit must be returned to the Board of Pharmacy.

South Dakota Department of Health Requirements:  The new pharmacy must obtain a South Dakota Controlled Substances Certificate of Registration issued by the Health Department.  The Permit from the SD State Board of Pharmacy must be obtained before submitting this application.  Apply to South Dakota Department of Health at the same time as the DEA.  Submit this application to:  South Dakota Department of Health, Office of Health Care Facilities Licensure and Certification, Attention: Bob Coolidge, R.Ph., 615 E. Drug Enforcement Administration Requirements:  The new pharmacy must apply for a DEA registration.  If the application is submitted before the Pharmacy Permit is obtained, the applicant may enter “pending” in the appropriate area.  

The registrant transferring the pharmacy business to another registrant shall notify the nearest DEA Registration Field office at least 14 days before the proposed date of transfer and provide the following information:

  • The name, address and registration number of the registrant discontinuing business;
  • The name, address and registration number of the registrant acquiring the pharmacy;
  • Whether the business activities will be continued at the location registered by the current business owner or moved to another location.  It the latter, give the address of the new location.
  • The date on which the controlled substances will be transferred to the person acquiring the pharmacy.

Sale (Transfer) of Controlled Substances:  On the date of transfer of the controlled substances, a complete inventory of all controlled substances being transferred shall be taken.  This inventory shall serve as the final inventory of the registrant-transferor and the initial inventory of the registrant-transferee, and a copy of the inventory shall be included in the records of each person.  Transfer of any substances listed in Schedule II shall require the use of DEA 222 order forms.

Destruction of Unusable Controlled Substances:  Contact the Board of Pharmacy office, or the Department of Health to destroy any unusable controlled substance products.
