Effective July 1st, 2016         Recent SD Nurse Practice Act Updates (take effect July 1, 2016)

Scope of Practice Updates.  SDCL 36-9-3 and 36-9-4 provide updates to the scope of registered nursing practice and licensed practical nursing practice.  These statutes have not been updated since 1976 for LPNs and 1986 for RNs. The updates reflect current practice which is neither expanded nor limited by the proposed revisions.

Board Composition Changes.  SDCL 36-9-5 establishes the composition of the Board of Nursing.  The Board would like to amend this statute to change the composition from six to seven RN Members; and to reduce LPN members from three to two.  The rationale for this change is to more closely represent the population of RNs and LPNs in this state.  There are nearly 17,000, active RNs and 2,500 active LPNs in SD.  The board will continue to be comprised of 11 members appointed by the Governor, including 2 public members.
