The mission of the South Dakota Board of Nursing is to safeguard life, health, and the public welfare, and to protect citizens from unauthorized, unqualified, and improper application of nursing education programs and nursing practices, in accordance with SDCL 36-9 and SDCL 36-9A.


Notice of Public Hearing to Adopt Rules

A public hearing will be held in the conference room at the South Dakota Board of Nursing Office at 4305 South Louise Ave, Suite 201, Sioux Falls, South Dakota, on June 28, 2018, at 1:00 p.m. CT, to consider the adoption and amendment of proposed rules.

  • Chapter 20:48:01 The effect of the amended rules will be to update the definition in this section to add certified registered nurse anesthetists (CRNA), clinical nurse specialists (CNS), certified nurse practitioners (CNP) and certified nurse midwives (CNM) to the definition of school. 

  • Chapter 20:48:06 The effect of the amended rules will be to raise the biennial renewal fees for RNs, LPNs, CRNAs and CNSs from $70 to $95. 

  • Chapter 20:48:07 The effect of the amended rules will be to update the approval of nursing education programs and add requirements for approval of advanced practice nursing programs.

  • Chapter 20:48:15 These rules will be repealed.  These rules are no longer effective with the enactment of the enhanced Nurse Licensure Compact in the 2016 Legislature and implementation on January 18, 2018.
  •  
  • Article 20:62 The effect will be to update nurse practitioners and nurse midwives rules in accordance with amendments made to SCDL 36-9A by the 2017 legislature.  Rules related to the joint regulation by the board of medicine and nursing are repealed. The requirement for a collaborative agreement with a physician for licensure is repealed for all licensees that have completed a minimum of 1040 practice hours. Biennial renewal fees are increased from $70 to $95.  New rules are added for the management of patient records, prescribing, and out of hospital birth practice.

Persons interested in presenting data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the South Dakota Board of Nursing, 4305 South Louise Ave., Suite 201, Sioux Falls, South Dakota 57106. Material sent by mail must reach the South Dakota Board of Nursing by June 20, 2018, to be considered.

After the hearing, the board will consider all written and oral comments it receives on the proposed rules.  The board may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.  Notice is further given to individuals with disabilities that this hearing is being held in a physically accessible place.  Please notify the SD Board of Nursing at least 48 hours before the public hearing if you have special needs for which special arrangements must be made.  The telephone number for making special arrangements is (605) 362-2760.
