Step 1 — Lodging Licensing Packet
Download the following materials (use ADOBE for applications and questionnaire) or call the Office of Health Protection, at (605) 773-3364 to request a packet.
A. Under South Dakota Codified Law 34-18-23, establishments must notify the Department of construction and alteration projects.
B. Under South Dakota Codified Law 34-18-22.1 and 34-18-22.2, specialty resorts must meet fire safety laws, effective 7-1-2005.
C. 30 days before construction begins, establishments must submit a detailed floor plan of lodging and water recreational facilities to the Office of Health Protection. Plans should be drawn to a recommended scale 1/8 " = 1 foot. Establishments larger than 4,000 square feet must have layout plans stamped by a professional engineer or architect.
D. Complete the plan review questionnaire from the licensing packet and submit it with the floor plan to:

D. If the establishment uses private sewer systems or water systems, the systems must be approved by the South Dakota Department of Environment and Natural Resources, (605) 773-3351.
E. Complete, notarize, and submit the license/registration application with correct fee 30 days before completion of construction to:

A. Department staff review the layout plan and plan review questionnaire.
B. The Department will send written notification regarding approval or changes required.
C. The Department will approve the facility plan once it is determined all areas of the plan are in compliance with the appropriate Administrative Rules of South Dakota — ARSD 44:02:02 Hotels, 44:02 05 Specialty Resorts, 44:02:06 Bed and Breakfast Establishments. (back to top)
During the construction process and prior to the business opening, the department will conduct an onsite inspection to determine compliance with administrative rules.

Step 5 — Approval for Licensing
The department will issue a lodging license once the license application is made, the plan review process completed, and a final inspection made to determine compliance.
