Step 1 — Complete the Food Service Licensing Packet

A. Under South Dakota Codified Law 34-18-23 establishments must notify the Department of any construction or alteration projects.
B. 30 days before construction begins, establishments must submit a a detailed floor plan of the food service kitchen to the Office of Health Protection. If the establishment is larger than 4,000 square feet, the layout plans must be stamped by a professional engineer or architect.
C. Complete the plan review questionnaire from the licensing packet and submit it with the floor plan to:

D.If the establishment uses a private sewer system or water systems, the systems must be approved by the SD Department of Environment and Natural Resources (DENR), 605-773-3351.
E. Complete, notarize, and submit the license/registration application with correct fee 30 days before completion of construction to:

F.Under ARSD 44:02:07:03, a food service establishment is required to have a certified food service manager. (How to get certified; scheduled ServSafe courses). (back to top)
A. Department staff will review the layout plan and plan review questionnaire.
B. The department will send you written notification regarding approval or changes required.
C. Once it is determined all areas of the plan are in compliance with the appropriate Administrative Rules of South Dakota, the department will approve the facility plan. (ARSD 44:02:07 Food Service Code) (back to top)
During the construction process and prior to the business opening, the department will conduct an onsite inspection to determine compliance with administrative rules. (back to top)
Step 5 — Approval for Licensing
The Department of Health will issue a food service license once the license application is made, the plan review process completed, a final inspection made to determine compliance, and the ServSafe food service course successfully completed. (back to top)
