Dr. Donn Fahrendorf called the meeting to order at 8:00 a.m. with board members Dr. Mark Bledsoe, Dr. Jeff Kramer, Dr. Jerrid Goebel and Jim Lawler present. Also attending the meeting was Marcia Walter, Executive Director.
M/S Lawler/Goebel to approve minutes of the December 4, 2010 board meeting
Passed, no opposition.
Marcia Walter presented the treasurer’s report. The state account currently has a balance of $205,153.05. With no additions or corrections, the board accepted the treasurer’s report as printed.
Discussion was held regarding the fact that the author of Olson’s Procedural Utilization Guideline has retired and once the books Marcia has in her office are gone, no more will be available. The board will look into what other sources of documentation are available, what are guidelines used in other states that do peer review, etc. and readdress at an upcoming meeting.
With the increased requirement of electronic health records, the board has opined that computer generated notes are acceptable as long as they are situationally specific. This would be required regardless if the notes are computerized or handwritten.

Dr. Fahrendorf called to recess the board meeting to administer new doctor matriculation at 10:00 a.m. - reconvened board meeting following matriculation and lunch at 12:30 p.m.
Marcia informed the board that the SD Supreme Court has issued its new rule on medical privacy, Rule 11-16. The court removed references to “claims” which was the biggest issue with Rule 10-07 and added language of “contemplation of litigation”. No further action is needed.
M/S Goebel/Kramer to have Dr. Bledsoe serve as delegate and Dr. Fahrendorf serve as alternate delegate at the FCLB Annual meeting in Florida, May 2011.
Passed, no opposition. Dr. Fahrendorf will be attending in place of Dr. Kramer.
Marcia Walter will not be attending either.

A request was received questioning if telemarketing was permissible under the rules adopted by the SDCE. The board’s legal council reviewed the request and it was determined that telemarketing may be in violation of the Board’s rules 20:41:10:02.01, 20:41:10:05.02 (10). Depending on the specific content of proposed telemarketing campaign, there may also be issues of inappropriate advertising and compensation arrangements may also raise questions of fee splitting. There may also be violations as it relates to the ACA Code of Ethics.
